Designs and Adopts Terms

By acquiring a design or artwork made by me you are agreeing to these terms.
Failure to follow my TOS will result in the design/artwork and its rights being stripped from you and you will be added onto my blacklist. Additionally, if you break my TOS I am not entitled to give you a refund, nor return a character if my design was acquired through character trade.

General Terms

- Credit the design back to me and never claim it as your own.
- You may modify the design and artwork in anyway. Any extra or alternative versions can be made as long as they are credited back to me. However, you may not hide or remove the original design and artwork please keep it visible.
- Do not delete my designs off ToyHouse.
- Users from my blacklist are not allowed to own a design made by me. If you sell a design to someone on my blacklist, you may also be blacklisted.
- DO NOT DELETE BIDS/MONEY OFFERS. ONLY BID IF YOU FULLY INTEND TO PAY. You will be blacklisted immediately if you do this.
- Payment plans are available for +$100 offers, WITH a downpayment of 50% (NON-REFUNDABLE); or a downpayment of 30% for +$150 offers (NON-REFUNDABLE). That is to guarantee I won't have buyers canceling out on me so often.
- After I have accepted your offer and linked you my paypal, you will have 24 hours to make payment (unless discussed otherwise). If you fail to pay within the 24 hours, I will move on to another offer.
- If your TH is under authorized only, please authorize me so that I can view my design.
- If offering a mixed offer that includes USD, please know it is non-refundable. Even if you fail to fulfil the rest of the offer.

Trading/Selling

- My designs may not be resold for more than what they have been acquired for. You can only add on extra monetary value to it if any kind of extra art has been bought for it, increasing it's original value. (Always check ownership history because I will put the amount originally purchased in the transfer comment.)
- Do not raffle my designs.

Forbidden

- Do not use the character for zoo art (aka feral nsfw), babyfur, hate speech or any harmful fetish. If drawing nsfw, use human anatomy....

Custom Designs

- My general design terms apply. Please note the special terms/term adjustments.
- You may NOT modify the design without my permission. Hue shifts are allowed but always keep the original artwork available to view.
- I do not recreate/take heavy inspiration from characters from media aka "kinsonas". It is against ToyHouse's TOS.

General Terms

- All drawings may or will include a signature that you may not remove or alter in anyway.
- Prices are subject to change based on demand.
- I have the right to reject any order that I do not feel comfortable drawing for any reason.

Payment

- Please do not fill out the feedback form on paypal after an invoice transaction. It is a trap that can put both our accounts at risk.
- The currency accepted is USD and can be paid through PayPal invoice.
- Commission payment must be confirmed before I begin your piece.
- Do not send me any payment before I have agreed to give you a slot and requested you to send me the payment.
- Please send payment within 24 hours, otherwise I will move onto the next person.

Process and Delivery

- I will give you a rough timeframe when I can begin sketching.
- I will provide you a sketch and make reviews with you to make it just right for you!
- Once the sketch is confirmed, I will begin the next stages (lining, colour, ect)
- The time it takes to finish your commission varies 2 weeks - 3 months depending on factors such as health, the complexity of the commissioned piece, other commissions, study and work.
- Please do not rush me and keep in mind of the timeframe stated above.
- If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap.

Revisions

- Any changes can be requested during the sketching stage.
- A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
- If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make.

Copyright / Usage Policy

I claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:
- Promote myself with it everywhere
- Publish books with it (artbooks, etc.)
- Display it everywhere to my liking (website, social media, etc.)
- Post it wherever I want
The buyer is allowed to:
- Use the commissioned piece for personal use (you can upload it on all your social media profiles, forums, etc.)
- Print the artwork and claim the character(s) as your own, but not the artwork itself.
The following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially - means making money off it in any way
- Claiming the artwork as your own
- Removing my signature from the artwork
- Altering the artwork without my consent
- I reserve the full rights to the image and it's use/distribution.

Refund / Cancellation Policy

- If you cancel your order before work has begun, you are entitled to a full refund.
- Once I've started work on your commission, refunds are not available. Provided the commission is delivered within the stated 3-month turnaround time.
- If the commission exceeds the 3-month turnaround time, you may request a refund. (see term below)
- If the commission exceeds the 3-month turnaround time and if some work has already been completed, a partial refund will be provided, with a fair amount retained to cover the work that has been done.
- If I am unable to start or complete your commission for any reason, you will receive a full refund.
- Refunds will be issued directly by me via the original payment method.
- Filing a chargeback instead of contacting me first may result in the revocation of the client’s license to use the commissioned artwork.
- Fraudulent or abusive chargebacks will be disputed using documented communication and progress records.
- Clients who abuse the chargeback system may be blacklisted.
- If the client violates these Terms of Service (including abusive behaviour), the commission may be terminated.
- In cases of serious breach or chargeback abuse, the client forfeits any license to use the artwork.
- Copyright ownership remains with the artist unless otherwise stated in writing.

What do you get?

- Sketch and/or final sketches that you must accept before I continue the work
- Once the piece is finished you will receive the full-resolution digital image. Note that there is no physical product.

Communication

- If you have any questions or doubts regarding my designs and the TOS, please communicate with me! Accidents and misunderstandings happen, and I will be happy to work with you in finding a solution.

Customer Satisfaction

- I will do everything I can to make my customers happy!
- I will do my best to provide good communication and updates.
- Please feel free to reach out to me at anytime.
- If you have a problem with anything in regards to the commissioned piece, please tell me right away so we can find a solution together.

Your Behavior

- Please keep all communication respectful, polite, and on-topic.
- Harassment, bullying, guilt-tripping, pressure tactics, excessive messaging, or disrespect toward my time, boundaries, or turnaround times will not be tolerated.
- You may request updates, but you may not rush, pressure, or attempt to manipulate me into prioritising your commission.
- If unprofessional, abusive, or inappropriate behaviour occurs, I reserve the right to terminate the commission.
- Commissions terminated due to client misconduct will not be refunded, regardless of whether work has begun.
- Attempting to bypass these terms through chargebacks or harassment will result in a permanent blacklist.
